Terms of Service
These Terms of Service govern your access to and use of Tomo, including our website, waitlist, mobile applications, messaging features, matching features, and runner meetup tools. By using Tomo, you agree to these Terms.
Tomo is a social platform for adults who want to meet running partners, chat, and organize runs. Tomo does not provide coaching, medical care, emergency services, or background checks.
1. Eligibility
You must be at least 18 years old to use Tomo. By using Tomo, you represent that the information you provide is accurate, that you are legally able to enter into these Terms, and that you will comply with all applicable laws.
2. Safety and Personal Responsibility
You use Tomo at your own risk. Running, meeting strangers, traveling to meetup locations, and sharing your location involve inherent risks, including injury, illness, property damage, assault, harassment, and death. Tomo cannot and does not guarantee your safety.
You are solely responsible for deciding whether to run with someone, where to meet, what route to take, what pace to run, and whether you are physically able to participate. Use common sense, meet in public first, tell someone where you are going, and contact emergency services if needed.
3. No Medical or Training Advice
Tomo is not a medical, health, or fitness professional. Content in Tomo is for general informational and social purposes only and is not medical advice, diagnosis, or treatment. You should consult a qualified professional before starting or changing a training plan.
4. Accounts and Profile Information
You are responsible for your account, login credentials, and all activity under your account. You may not impersonate another person, create a fake identity, or misrepresent your age, running experience, pace, location, or intentions.
5. Acceptable Use
You may not use Tomo to:
- harass, threaten, stalk, exploit, or harm another person;
- post false, misleading, defamatory, obscene, hateful, or discriminatory content;
- send spam, scams, commercial solicitations, or malware;
- collect other users' data without permission;
- promote unsafe, illegal, or dangerous activity;
- circumvent moderation, access controls, or security protections.
6. User Content and License
You retain ownership of the photos, messages, profile text, meetup details, and other content you submit to Tomo. You grant Tomo a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, modify for formatting, and use that content as needed to operate, improve, secure, and promote the service.
You represent that you have the rights needed to post your content and that your content does not violate any law or another person's rights.
7. Meetups, Messages, and Matches
Tomo provides tools to help users discover each other, message, and organize runs. Tomo is not a party to any interaction, meetup, agreement, or dispute between users. We do not supervise runs, verify identities, verify pace claims, or guarantee that any user is compatible, safe, available, or who they claim to be.
8. Moderation and Removal
Tomo may monitor, review, remove, restrict, or refuse content or accounts at any time if we believe they violate these Terms, create safety risks, expose us or our users to liability, or harm the service. We are not obligated to monitor all conduct or content.
9. Privacy and Data
By using Tomo, you acknowledge that we may collect and use information such as account details, profile content, messages, device information, approximate or precise location, and usage data to operate the service. Our separate Privacy Policy explains how we handle personal information.
10. Third-Party Services
Tomo may link to or rely on third-party services, including app stores, maps, analytics, payment tools, email tools, and community platforms. We are not responsible for third-party services or their acts, omissions, terms, or privacy practices.
11. Termination
You may stop using Tomo at any time. Tomo may suspend or terminate your access at any time, with or without notice, if you violate these Terms, create risk, or if we discontinue part or all of the service.
12. Disclaimers
Tomo is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Tomo disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, availability, and safety. We do not warrant that the service will be uninterrupted, secure, error-free, or that interactions with other users will be safe or satisfactory.
13. Limitation of Liability
To the fullest extent permitted by law, Tomo and its affiliates, officers, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, business interruption, personal injury, emotional distress, property damage, or death arising out of or related to your use of Tomo, your reliance on the service, or your interactions with other users, even if we have been advised that such damages are possible.
To the fullest extent permitted by law, the total liability of Tomo for any claim arising out of or relating to the service will not exceed the greater of $100 USD or the amount you paid to Tomo, if any, in the 12 months before the event giving rise to the claim.
14. Indemnity
You agree to defend, indemnify, and hold harmless Tomo and its affiliates, officers, employees, contractors, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your content, your use of Tomo, your violation of these Terms, or your violation of any law or another person's rights.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we may post the updated Terms on the website or in the app and update the effective date above. Your continued use of Tomo after the updated Terms take effect means you accept the revised Terms.
